Maine Marijuana Card law has allowed prescribing, and limited possession, of medical marijuana since 1999 but the law lacked any distribution laws and questions arose of noncompliance with federal law and of how cannabis patients could legally obtain the prescribed medical marijuana. In October the Obama administration announced that it would stop prosecution of medical marijuana users and caregivers or growers if they were in compliance with their state’s law.

Having your Cannabis Card in Maine will eliminate State-level criminal penalties on the use, possession and cultivation of medical marijuana by cannabis patients who possess an oral or written “professional opinion” from their doctor that he or she “might benefit from the medical use of marijuana.” The law does not establish a state-run marijuana patient registry. Medical marijuana Patients (or their primary caregivers) may legally possess no more than one and one-quarter (1.25) ounces of usable marijuana, and may cultivate no more than six marijuana plants, of which no more than three may be mature. Those cannabis patients who possess greater amounts of marijuana than allowed by law are afforded a “simple defense” to a charge of marijuana possession.
